During the 2010 Regular Session, two major agriculture bills passed the legislature.  HB 7103 by the House Agriculture and Natural Resources Committee contained language which preempts county regulations that pertain to agricultural operations under certain circumstances.  FAC has historically opposed this bill.  However, this year’s bill contains compromise language that allows some regulations to continue, including certain wetlands, springs, and stormwater ordinances.  The bill also contains stormwater language which restricts stormwater assessments that apply to agricultural operations.  This provision also contains compromise language that was drafted with input from the Florida Stormwater Association and others.  HB 981 by Representative Grimsley also passed.  This bill clarifies that land classified as agriculture retains that classification when offered for sale.  FAC remained neutral on this bill.  While FAC did not request a veto for either bill, both were vetoed by Governor Crist.  In his veto letters, the Governor cited concerns relating to local control. FAC does share concerns relating to local control over environmental regulations, and appreciates the Governor’s thoughtful consideration of environmental and local government issues.
