Last week in the United States District Court for the Northern District of Florida, Judge Robert Hinkle issued an Order clarifying the Consent Decree deadlines.  According to the Order, the EPA’s motion to clarify (or to actually modify) the Order extending the deadlines was granted, meaning that any deadline to publish a final rule on downstream protection values for estuaries and South Florida marine waters is extended to 30 days after the ruling on the motion to modify.   The EPA has until September 6, 2013 to file a reply in support of the motion along with a response to the plaintiffs’ motion to enforce the original consent decree.
